Welcome to BudBud Supply Co. ("BudBud," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of budbudsupply.co (the "Site") and any products purchased through it. By accessing the Site or placing an order, you agree to be bound by these Terms. If you don't agree, please do not use the Site.

1. About us

BudBud Supply Co. is a Delaware Limited Liability Company, foreign-registered in New Jersey, operating from Fairfield, NJ. We design and sell smoking accessories direct-to-consumer through this Site, through wholesale partners, and on third-party marketplaces.

2. Eligibility and age requirement

You must be at least 21 years old (or the legal smoking age in your jurisdiction, whichever is higher) to purchase from this Site. By placing an order, you confirm that you meet this age requirement. International customers are responsible for ensuring they meet the legal age requirements in their country.

We reserve the right to refuse service, cancel orders, or terminate accounts if we have reasonable grounds to believe a buyer is underage.

3. Product use disclaimer

BudBud products are smoking accessories — they are designed for use with legal substances permitted in the buyer's jurisdiction. BudBud does not sell, distribute, or condone the use of cannabis or any controlled substance. It is the buyer's sole responsibility to ensure that their use of our products complies with all applicable federal, state, local, and international laws.

By purchasing from BudBud, you acknowledge that:

  • You are using our products at your own risk
  • BudBud is not responsible for any legal, health, or other consequences resulting from your use of our products
  • Our products are intended for adult use only

4. Account registration

You may purchase from the Site as a guest or by creating an account. If you create an account:

  • You're responsible for maintaining the confidentiality of your login credentials
  • You're responsible for all activity under your account
  • You must provide accurate, current, and complete information
  • You must notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent activity.

5. Orders, pricing, and payment

Order acceptance. Placing an order is an offer to buy, not a binding contract. We reserve the right to accept, decline, or cancel any order at our discretion — including for reasons such as suspected fraud, unverifiable address, age verification failure, pricing errors, or inventory issues. If we cancel your order, we'll refund any payment you made.

Pricing. All prices are in U.S. dollars unless otherwise stated. Prices are subject to change without notice. We make every effort to display accurate pricing, but in the event of a pricing error, we reserve the right to cancel orders affected by the error and refund any payment.

Payment. We accept payment through Shopify's checkout, Authorize.Net, and any installment options (such as Shop Pay Installments or Klarna) shown at checkout. By providing payment information, you represent that you are authorized to use the payment method.

Sales tax. Sales tax is calculated at checkout based on your shipping address and applicable state and local tax laws. International customers may be responsible for additional duties, taxes, or customs fees imposed by their country.

6. Shipping and delivery

Domestic shipping. Orders ship from New Jersey, USA. Standard delivery typically takes 3–5 business days after the order ships. Free shipping applies to qualifying orders as displayed on the Site.

International shipping. We ship to over 25 countries. International delivery typically takes 7–14 business days, depending on destination and customs processing. International customers are responsible for all duties, customs fees, taxes, and any other import charges imposed by their country. BudBud is not responsible for delays caused by customs.

Discreet packaging. All orders ship in plain packaging with no BudBud branding visible from the outside.

Risk of loss. Risk of loss and title for products pass to you upon our delivery to the carrier. We are not responsible for items lost or damaged in transit, but we will work with you to resolve issues with the carrier where possible.

7. Returns, exchanges, and refunds

Standard return policy. We accept returns on unused, unopened products within 30 days of delivery. To start a return, email high@budbudsupply.co.

Defective products. If your product arrives damaged or defective, contact us within 7 days of delivery with a photo of the damage. We'll replace it at no charge.

Final sale. Custom orders, sale items, and apparel are final sale unless defective.

Refund processing. Approved refunds are issued to the original payment method within 5–10 business days of receiving the returned item.

8. Wholesale and affiliate programs

If you participate in our wholesale program, affiliate program, or any other partnership program, additional terms apply. Those terms are provided when you apply, and form a separate agreement that supplements (and where it conflicts, supersedes) these Terms with respect to that relationship.

9. Intellectual property

All content on the Site — including product designs, photography, logos, copy, graphics, and trademarks — is the property of BudBud Supply Co. or its licensors and is protected by U.S. and international copyright, trademark, and patent laws.

Patent-pending designs. Certain BudBud products, including the BudBud Tool, are protected by pending patents. Unauthorized reproduction, manufacture, or sale of products incorporating our patented or patent-pending designs is prohibited.

Trademarks. "BudBud," "BudBud Supply Co.," the BudBud logo, and product names including "BigBud," "Joint Flask," and "Happy Packing Tin" are trademarks of BudBud Supply Co. registered in NJ, NY, and RI, with additional protections in other jurisdictions.

Limited license. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any Site content without our written permission.

10. User-generated content

If you submit reviews, photos, comments, or other content to the Site (collectively, "User Content"), you grant BudBud a non-exclusive, worldwide, royalty-free, perpetual, transferable license to use, reproduce, modify, publish, and display that content in connection with our business — including marketing, advertising, and website use.

You represent that:

  • You own or have the right to submit the User Content
  • The content does not violate any third-party rights
  • The content is not unlawful, defamatory, obscene, or otherwise objectionable

We reserve the right to remove any User Content at our discretion.

11. Prohibited uses

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems, accounts, or networks
  • Use bots, scrapers, or automated means to access the Site (other than for legitimate search engine indexing)
  • Misrepresent your identity or age
  • Resell BudBud products without authorization
  • Reverse engineer, copy, or replicate our patent-pending designs
  • Submit false, misleading, or fraudulent reviews
  • Interfere with the security or operation of the Site
  • Violate any applicable laws or regulations

12. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, BUDBUD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or virus-free, or that any defects will be corrected. We do not warrant that products will meet every customer's expectations or be suitable for every use case.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUDBUD AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY — ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions don't allow limitations on certain warranties or liability, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless BudBud Supply Co., its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site or products, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any User Content you submit.

15. Governing law and dispute resolution

Governing law. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. For any matters where Delaware law does not apply, the laws of the State of New Jersey apply.

Jurisdiction. Any dispute arising from or relating to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in New Jersey. You consent to the personal jurisdiction of those courts.

Informal resolution first. Before filing any legal claim, you agree to first contact us at high@budbudsupply.co and attempt to resolve the dispute informally. We'll do the same.

Class action waiver. To the extent permitted by law, you agree to resolve any disputes individually and waive any right to participate in a class action, class arbitration, or representative proceeding.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated via email or a banner on the Site. Continued use of the Site after changes constitutes acceptance of the updated Terms.

17. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including violation of these Terms. Upon termination, your right to use the Site ends immediately. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.

18. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy and any program-specific terms (wholesale, affiliate), constitute the entire agreement between you and BudBud regarding your use of the Site.

Severability. If any provision is found unenforceable, the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any right under these Terms is not a waiver of that right.

Assignment. You may not assign your rights under these Terms without our consent. We may assign our rights freely.
